Legal Review and Implications of Interfaith Marriage in Indonesia: A Perspective from the Compilation of Islamic Law

Abstract

Interfaith marriage remains a complex and controversial legal issue in Indonesia. This study aims to examine the regulation and legal implications of interfaith marriage based on the Compilation of Islamic Law (KHI). The research method used is normative juridical with analysis of laws and regulations and related legal doctrines. The results of the study indicate that the KHI strictly prohibits marriage between Muslim men and non-Muslim women and vice versa, as regulated in Article 40 letter (c) and Article 44 of the KHI. The legal implications of interfaith marriage that are not in accordance with the KHI include the invalidity of the legal status of husband and wife, the status of children, inheritance rights, and the issue of joint property in marriage.
